LACALUT “Smile of the Month” — Terms & Conditions (Game of Skill)

  1. Promoter. Smartek Labs Pty Ltd (ABN 86 628 313 539), trading as LACALUT Australia, 4 Tamarang Street, Tarragindi QLD 4121. Contact: [email protected]
  2. Game of skill. This is a GAME OF SKILL — chance plays no part in determining the winner. Each calendar month, the entrants with the highest points become finalists. The Promoter's judges then select the winner from those finalists based on the creativity, quality and authenticity of their submitted photo or video entry. The most original and engaging entry, in the judges' opinion, wins. The judges' decisions are final and no correspondence will be entered into.
  3. No purchase. No purchase is necessary to enter or win.
  4. Eligibility. Entry is open to Australian residents aged 18 years or over. Employees of the Promoter and their immediate families are ineligible.
  5. How to enter & earn points. Enter via the campaign page and earn points for eligible actions, including uploading a photo or video, referring friends, following our social channels and sharing. Point values are shown on the campaign page and may be updated from time to time.
  6. Entry periods. The competition runs on an ongoing monthly basis. A winner is selected once per calendar month based on points accumulated during that month. Points reset at the start of each new monthly period (your registration carries over — you do not need to re-enter).
  7. Prize. One (1) winner per month receives a year’s supply of LACALUT oral care — 12 toothpastes, 12 mouthwashes and 12 toothbrushes. The prize is not transferable or redeemable for cash and will be shipped to an Australian address in one delivery.
  8. Claiming. Winners must claim within 14 days of notification. Unclaimed prizes may be awarded to the next-highest eligible finalist. The Promoter may substitute a prize of equal or greater value if the stated prize becomes unavailable.
  9. Winner notification. Winners will be notified by email and/or via the contact details provided, and may be featured publicly as "Smile of the Month" across LACALUT channels.
  10. User content licence. By uploading a photo or video, you grant the Promoter a perpetual, royalty-free, worldwide licence to use, reproduce, edit and publish that content across any media (including advertising, social media and the LACALUT website). You confirm the content is your own and that you have the right to grant this licence.
  11. Moral rights. You consent to any act or omission by the Promoter that would otherwise infringe your moral rights, including use without attribution and modification or editing of your content.
  12. Third parties in content. If any other person appears in your content, you warrant you have their consent (and a parent's or guardian's consent for anyone under 18) to this licence.
  13. Indemnity. You indemnify the Promoter against any claim arising from your content or its use as permitted under these terms.
  14. Privacy. Personal information is collected and handled in accordance with the Promoter's Privacy Policy. By entering, you consent to receiving marketing communications from LACALUT Australia, which you may opt out of at any time.
  15. Disqualification. The Promoter may disqualify any entrant who tampers with the entry process, submits fraudulent, offensive or infringing content, or breaches these terms.
  16. Changes. The Promoter may amend, suspend or cancel this competition where reasonably necessary, subject to applicable law.
  17. Platform terms. Entrants must comply with the terms of any platform used to enter (e.g. Facebook, Instagram, TikTok).
  18. Consumer law. Nothing in these terms excludes rights or guarantees you have under the Australian Consumer Law. To the extent permitted by law, the Promoter's liability is limited and it is not liable for indirect or consequential loss.
  19. Platform disclaimer. This competition is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram, TikTok, YouTube or any other platform.
  20. Governing law. These terms are governed by the laws of Queensland, Australia.
